David Cassidy was arrested on a charge of Driving Under the Influence on Wednesday in Florida.
According to the police report, a Florida state trooper pulled the singer over on Wednesday night about 6 PM after seeing his Mercedes driving erratically, crossing the center line and cutting off another driver.
The officer reported that Cassidy was unsteady on his feet and smelled of alcohol. Even though the singer claimed that he had only had one glass of wine with lunch and a hydrocodone tablet at about 3:30, he failed a number of sobriety tests and was administered a test for alcohol level which was determined to be .14, well above the legal limit of .08. The police also said that there was a half of a bottle of bourbon in the back seat.
Cassidy was charged with DUI, driving with an open container of alcohol in his vehicle and failure to maintain a single lane. He was released on $350 bail after spending nine hours in jail.
Since the arrest, Cassidy and his reps have said that he will fight the charge, saying that the two Breathalyzer tests taken did not properly measure his blood alcohol level. His rep, Jo-Ann Geffen, said "He would never jeopardize anyone on the road and he would not have been driving had he not had to go to a funeral. He's never been arrested in his life before for anything."
