According to MTV.com Sum 41 are facing a serious lawsuit. Earlier this month a man in Rochester, NY, by the name of Michael Sudore filed a suit against the band, claiming $6 million in damages.
And, in true American lawsuit style, the lawsuit concerns a thrown hotdog.
Sudore ran into Sum at a minor league baseball game in Rochester a couple years back when the band were filming footage for the bonus DVD that is included with their last CD, 2002's Does This Look Infected? The video includes footage of the band ridiculing Sudore and throwing the hot dog at him. The clip made the final cut of the DVD.
Sudore claims that he was unaware of his 15 minutes of bonus DVD fame until a client of his home-improvement business spotted him on their children's copy of the disc. Sudore claims that the on-screen insult has since negatively affected his business and has also caused significant psychological trauma. The law in the state of New York does not permit the unauthorized use of a person's image.
Sudore's suit also names Universal Music, Island Def Jam, Lucifer Productions and Aquarius Records. Treble Charger singer Grieg Nori, who moonlights as Sum 41's manager and producer, is also implicated in the suit, as he is credited as the DVD's producer.
