Tom Waits has won the first step in a legal battle with Audi in a Spanish Court.
Waits took action against Volkswagen-Audi Espana (VAESA) after they modified his music and impersonated his voice for the commercial which screened in Spain in 2000.
The company had originally requested use of his song 'Innocent When You Dream' but he refused. Waits claimed the finished commercial used the same song structure as his song and the vocal was an impersonation of his voice.
The singer discovered the company has released the commercial after Spanish fans on his website started to talk about it in discussion groups.
