The 'Mean Girls' actress has flown back to the US from the Cannes Film Festival in France to stand before a judge after violating her probation following her arrest for driving under the influence (DUI) in 2007.
Lindsay's parents Michael and Dina Lohan – who are divorced – will not be attending their daughter's hearing.
Michael told X17 Online: "I am in New York and not going to Lindsay's appearance tomorrow. The hearing is of no consequence because incarceration or judgment are not options at this time. Dina and I will be at the probation violation hearing, at which time, we will support Lindsay, in a way that will help her and be of best benefit to her present state and well being."
The 23-year-old actress avoided arrest last week after paying £70,000 bail and agreeing to drink no alcohol, wear a SCRAM bracelet – which monitors alcohol consumption of the wearer - and submit to weekly random drug tests.
An arrest warrant was issued after Lindsay was unable to get back to Los Angeles for her bail hearing because she had her passport stolen.
However, it has been alleged the actress enjoyed several glasses of red wine on Saturday (22.05.10) as she took a British Airways flight to London to catch an ongoing flight to the US.
Judge Marsha Revel, who issued the warrant, will not be in court today because she is on vacation. She will be replaced by another judge.
