Christina Fulton claims in her lawsuit that Cage had vowed to give her legal title to the property in Los Angeles where she could bring up their son.
Fulton, who lived with Cage for four years but never married him, states that after confronting Cage about the legal title in 2009 he gave her 60 days to vacate the home.
As part of her lawsuit in Los Angeles Superior Court, Fulton is also suing her financial advisors, recommended to her by Cage, as well as the actor claiming damages of $5m plus interest.
In additional court filings, lawyers for Fulton want Cage to sit for a further deposition so they can ask him questions about his understanding of Weston's 'medical and mental health condition.'
Cage underwent one in April 2011, in which he was instructed by lawyers to not answer questions about his son's medical conditions, including questions such as 'When Weston was approximately nine was he diagnosed with severe depression and suicidal tendencies?'
He also refused to answer the question, 'Between the ages of five and 15, was Weston diagnosed with Tourette's?'
